A Tallahassee doctor faces some very serious allegations of misconduct. ABC 27's Rebecca Baer has been following the story and joins us with more on what a long-time patient says he did. It's not just misconduct, police are charging Uchenna Emenike with sexual battery after a patient says he had sex with her in his office; without her consent.

His parking space at "Impact Health" is empty tonight. Uchenna Emenike won't be back to see patients anytime soon. Over the weekend the doctor was arrested and charged with sexual battery.

According to court papers, a patient says she went to the Capital Circle Medical practice for a stomach ailment. She alleges that during the exam Emenike had sexual intercourse with her, without her consent. Police say "controlled phone calls" help support the alleged victims claims.
David McCranie of the Tallahassee Police Department said, "Controlled phone calls were recorded phone calls in which the victim and Dr. Emenike conversed and specific issues were discussed about the case itself which confirmed in the investigators mind that a sexual battery did occur."

The victim says this wasn't the first time. In court documents she claims the doctor touched her inappropriately at a previous appointment. So far none of Emenike's other patients have come forward with allegations. In fact, a colleague at Florida State University, where Emenike had been an assistant clinical professor says he never heard concerns from students there.

Police urge anyone with information about this case, or any other case of misconduct, to not hesitate to bring it to their attention.
McCranie went on to say, " There are certain careers that we as citizens entrust people police officers, doctors, clergy, if you're ever put in a position where you feel uncomfortable or something doesn't seem right, leave immediately and contact the police and let us investigate it fully so no one else is hurt." Police also say they have DNA evidence to prove Emenike had sex with the patient.

We tried to get an interview with his attorney tonight and our calls were not returned. However, the doctor's mother in law says she told him he had sex with the patient, but it was consensual and now she's trying to black mail him.

Today new details in the case of a Tallahassee doctor accused of sexually assaulting a patient. ABC 27's Amanda Anderson spent the day digging and reports.

Patients still wait in the lobby if Impact Health, they're waiting to see Mignon Emenike. The wife and business partner of Uchenna Emenike is a pediatrician and family care physician. He was arrested after a patient made claims he assaulted her.

Police say they have evidence which Emenike's attorney is disputing it here's what we know. One woman, who is a patient and sees Dr. Emenike's wife, said she was shocked to hear the news and says it won't stop her from coming to the office. She's not alone; we saw several people there but were asked to leave when we tried to talk to his wife.

Two other women chased us off the property leaving us with more questions than answers, here is what we do know.

The patient is an adult woman who had been seeing Emenike for some time for different ailments including stomach troubles and a mental condition. She also had trouble paying her bills at the office from time to time. In October, the patient claims the first incident happened in the probable cause affidavit the woman told investigators.

After this, she says she called a sexual abuse hotline but can't remember when or who she spoke with. Under Florida law, we'll never know.
"All staff are protected by privilege can never go back and speak about what's happened," said Emily Mitchem of Refuge House.

Despite her first claims, the woman went back to Dr. Emenike, which sexual assault experts say is unusual. "The voluntary contact rare, I would say it's very rare," Mitchem added.

Let's not be too quick to condemn the man. Something about the whole set up seems fishy. Only time will tell.

Not saying he did or didn't do it, but something really smells fishy. A mentally ill patient, who couldn't pay her bills, claims she was assaulted and yet kept going back? Hmmmm.....


And by the way after several "controlled" phone calls as they put it, they could have controlled the conversation in such a way that the guy will use certain words and then doctor the tape afterwards. As of now we don't know who is telling the truth.

However the man was stupid sleeping around when he has a wife at home.

how could the man have penetrated or had sex with her without her consent ...he didn't tie her legs or hands and why couldn't she scream so that the nurses could come to her aid. Am sure they had an affair going on ..... ... thats was how one wanted to frame my brother up for something so minute but luckily for my brother he had the nurses there to back him up

In another case one of his colleague treated a guy that came with a gun shot almost at the point of death ... you wont believe the same guy came back to sue the Doctor saying that he was not suppose to have treated him ......fortunately for the doctor the guy had a signed a form giving his consent so he had no case .....this people are very bad ....... especially blacks ..... don't joke with them ...
