However, it is traditionally extremely difficult to obtain damages of negligence in relation to public bodies such as the police, the hospitals etc. The problem is that judges have traditionally insisted that if such claims are allowed, public bodies will resort to defensive practices and that could be detrimental to society. This brings to mind an interesting question: was the hospital negligent in their duties or would saving her life result in the death of another individual on the list? I also believe the judges should look at the role of the Home Office in this matter, although they will argue it is with in their discretion and therefore it is up to them to decide whether she gets indefinite leave to remain in the UK or not.

Her lawyers will probably be using Article 3 of the Human Rights Act which gives everyone "the right to life". But the main question that will probably be on the minds of the judges is; did the hospital owe her a specific duty of care even though saving her life would probably lead to the death of another person on the list?

Hmmm...."D law". Med, fun rare. Champ!

This is all the neccessary things Good healthcare system that our goverment should provide it citizen. instead of stealing the money and throwing it subjects to the mercy of other nations. This is a shame. Even if this lady was going to die. She should have been given a chance.

29 year old, three children. Very Sad. I think I read this story a while back unless it's another. It is still sad to read the details again

I am realy sorry for her family and may she rest in peace but like Mimi said,I blame not the UK government but our own. If that lady had been a Brit, her country would have done anything possible to fly her home and at least by the time she died if they did not get a donor in time, no one would blame them!
That however can NEVER happen in most of our African countries because that would affect the Health Minister's daughter's pocket money while she takes her studies in Swiss or Even the UK where the lady died.

Oh hail our killers...errr...em...sorry our leaders!!!

No not that one, I'm not aware of the Ghanian woman's case, I read about a Nigerian woman with 3 kids (I think back in the summer 2007 or thereabout) whose visa had run out and was left to die without a major operation. It was stated that she came to the UK to join her husband and she went into labour and gave birth. She was later ill and following treatment, they needed to perfom on her (due to her visa running out) but because she was illegal at the time they could not help her. It was in the metro infact with the woman's picture on the front page I think.
